TOOL FOR SELF ASSESSMENT OF VARIOUS EHS LEGAL REQUIREMENTS

The system to comply with EHS Legal Requirements and go beyond is an integral part of most of the management systems. However, there is a huge gap from company to company and from one region to another in the world. The following tool has been developed to facilitate companies assess their status. They may need some expert advice to know about the latest changes in EHS regulations so that they know their own status.

This tool can also help companies select appropriate level of technology and external/ internal support needed to move from one level to another. eg If the company is at level 1, an EHS software dashboard may be too far fetched a tool but they may require external advisory support to move to Level 2 or 3 where they can then, shift to internal resources.

Level 1. No Idea of the latest updates ie not aware of more than 50% of changes in the last five years. No formal system of identification of changes in EHS Regulations. No formal system to evaluate compliance proactively. Only reacts to Violations notices, correspondence and/or Show Cause Notices of the Government.

Level 2. Aware of most of the regulatory update. Ie aware of more than 90% of changes in the last five years. A formal system of identification of changes in EHS Regulations. A formal system to evaluate compliance status. However, updates not reviewed regularly and internal tracking and evaluation weak. Failure to capture gaps in compliance status in the system to initiate corrective actions.

Level 3. Aware of most of the regulatory updates ie Aware of more than 90% of changes in the last five years. A formal and effective system to review changes in EHS Regulations. There is a review to find out its applicability and take actions thereupon.

Level 4. Aware of most of the regulatory updates ie Aware of more than 90% of changes in the last five years. A formal and effective system to review changes in EHS Regulations and link them to Risk Assessment through Environmental Aspect-Impact Analysis and Hazard Identification and Risk Assessment. Internal Communication process in place to relevant people about the implications of changes. Gaps in compliance captured in the system of evaluation of compliance and reviewed in the management review.

Level 5. Aware of most of the regulatory updates ie Aware nearly 100% of changes in the last five years. Also, aware of the draft regulations that are reviewed for their applicability and integrated with business planning with allocation of any additional resources, revisions in procedures. A formal and effective system to review changes in EHS Regulations and link them to Risk Assessment through Environmental Aspect-Impact Analysis and Hazard Identification and Risk Assessment.

Gaps in compliance captured in the system of evaluation of compliance and reviewed in the management review and corrective actions initiated on a priority. Communication done to the regulatory agencies for any grey areas indicating an approach of proactive compliance and go beyond compliance in areas that are not clear or clearly applicable ie Err on the safer side.
